1. Agreement to Terms
By accessing or using Morphex Tech Solutions' website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations of South Africa. If you do not agree with any of these terms, you are prohibited from using our services. These terms constitute a legally binding agreement between you and Morphex.
2. Our Services
Morphex provides the following tech solutions to businesses and individuals in South Africa:
- Website and Application Development - Custom websites, web apps, and mobile applications
- Software and Hardware Repair - Laptop, computer, and desktop repairs and maintenance
- AI Integration - Personalised AI solutions and automation
- Video Editing - Professional video production and editing services
- Graphic Design - Branding, logos, marketing materials, and visual design
- Social Media Marketing - Digital marketing, ads management, and content strategy
3. Pricing and Payment
All prices are quoted in South African Rand (ZAR) and are subject to change. Our standard pricing packages include:
- Starter Package: From R 3,000
- Professional Package: R 5,000 - R 10,000
- Enterprise/Custom: Contact sales for pricing
A 50% deposit is required before project commencement. The remaining balance is due upon project completion and client approval. Payments can be made via EFT, card, or other agreed methods.
4. Project Terms
Timeline
Project timelines are estimates and may vary based on project complexity and client responsiveness. Delays caused by late content submission or feedback may extend timelines.
Revisions
Each package includes a specified number of revision rounds. Additional revisions may incur extra charges at our standard hourly rate.
Content
Clients are responsible for providing all content (text, images, logos) unless content creation is included in the project scope.
5. Intellectual Property
Upon full payment, clients receive full ownership of the final deliverables, including source files where applicable. Morphex retains the right to showcase completed work in our portfolio unless otherwise agreed in writing.
Third-party assets (stock images, fonts, plugins) may be subject to their own licensing terms and are the client's responsibility to maintain.
6. Warranties and Liability
Morphex provides a 30-day warranty on all completed work for bug fixes and technical issues arising from our development. This does not cover issues caused by third-party modifications, hosting problems, or client changes.
To the maximum extent permitted by South African law, Morphex's total liability is limited to the amount paid for the specific service in question.
7. Cancellation and Refunds
Projects may be cancelled by either party with written notice. Refunds are processed as follows:
- Cancellation before project start: Full refund minus 10% administration fee
- Cancellation during project: Refund proportional to work not yet completed
- Cancellation after delivery: No refund
8. Hardware Repair Terms
For hardware repair services:
- A diagnostic fee may apply before repair quotation
- Morphex is not liable for data loss; clients should backup data before submission
- Repairs carry a 90-day warranty on parts and labour
- Devices uncollected after 60 days may be disposed of
9. Governing Law
These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or our services shall be resolved in the courts of South Africa, with preference for mediation before litigation.
10. Changes to Terms
Morphex reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the new terms.
